According to a translation of Sakurai’s liner notes from the Club Nintendo Smash Bros. soundtrack, Nintendo was not able to sell the soundtrack due to licensing issues.
Sakurai states that “We can’t SELL a Smash CD due to licensing issues, so I’m glad we could offer it to you as a PRESENT.” It would seem that Nintendo had considered selling the soundtrack but was not able to; however, they found a loophole that allowed them to give the CD away for free.
